GPSS World Student License
Agreement 5.2
Minuteman Software provides this
Software free of licensing fees, but subject to license restrictions. Title
to the licensed Software and copyrights shall remain with Minuteman Software.
The software
is to be used solely for noncommercial educational purposes.
LICENSE
You may:
a. use the
Software on any number of computers;
b. copy the Software for backup purposes in
support of your use of the Software; and,
c. transfer an uninstalled copy of the
Software to another party if the party agrees to accept the terms and conditions
of this Agreement between that party and Minuteman Software.
You must:
a. reproduce and include the copyright
notice on every copy.
You may not:
a. use the software for
commercial purposes,
b. sublicense, rent, or lease the
Software,
c. remove copyright or proprietary
notices,
d. modify internal logic or serial
numbers,
e. reverse assemble or reverse compile
the Software, or
f. allow any third party to violate the
terms of this agreement.
YOU MAY NOT USE, COPY, MODIFY, OR TRANSFER
THE PROGRAM, OR ANY COPY, MODIFICATION, OR MERGED PORTION, IN WHOLE OR IN PART,
EXCEPT AS EXPRESSLY PROVIDED FOR IN THIS LICENSE.
TERM
The license is effective until terminated.
You may terminate it at any other time by destroying the Software together with
all copies in any form. It will also
terminate upon conditions set forth elsewhere in this Agreement or if you fail
to comply with any term or condition of this Agreement. You agree upon such
termination to destroy the Software together with all copies in any form.
AS IS
Minuteman Software provides this Software 'as is', without warranty of any kind. No
warranty is expressed or
implied.
THE FOREGOING IS IN LIEU OF ALL OTHER
WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED
WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
LIMITATIONS OF REMEDIES
IN NO EVENT WILL MINUTEMAN SOFTWARE BE
LIABLE TO YOU FOR ANY DAMAGES, INCLUDING ANY LOST PROFITS, LOST SAVINGS OR OTHER
INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE
SUCH PROGRAM EVEN IF MINUTEMAN SOFTWARE OR AN AUTHORIZED DEALER HAS BEEN ADVISED
OF THE POSSIBILITY OF SUCH DAMAGES, OR FOR ANY CLAIM BY ANY OTHER PARTY.
GENERAL
You may not sublicense, assign, or transfer this
license except as expressly provided for in this agreement. Any attempt
otherwise to sublicense, assign, or transfer any of the rights, duties, or
obligations is void.
This Agreement shall be governed by the laws of
the State of North Carolina, United States of America.
Failure by any party to enforce any contract term
will not be deemed a waiver of the right to enforce that term later. This
Agreement replaces all prior communications and constitutes the entire Agreement
between the parties with respect to its subject matter. No deviations from these
terms and conditions will be binding unless in writing and signed by the party
against whom the same is sought to be enforced.
